This field of expertise entails the drafting of township layouts and township establishment. Several Subdivision applications were made in terms of the Division of Land Ordinance, 1986 (Ordinance 20 of 1986) and the Spatial Planning and Land Use Management Act, Act 16 of 2013 in the City of Tshwane, Kungwini, Nokeng, Halfway House & Clayville, Mookgophong, Madibeng, Ekurhuleni, and the City of Johannesburg Metropolitan Municipality and Metropolitan Areas.

Several Subdivision applications were made in terms of Section 92 of the Town Planning and Townships Ordinance (Ordinance 15 of 1986) and the Spatial Planning and Land Use Management Act, Act 16 of 2013 in the City of Tshwane, Halfway House & Clayville, Mookgophong, Nokeng, Ekurhuleni and the City of Johannesburg Metropolitan Municipality and Metropolitan Areas.

Consent were also obtained in terms of Act 21 of 1940.

Subdivision applications were also made in terms of Act 70 of 1970 submitted to the National Department of Agriculture, Forestry and Fisheries for consideration. Assisting Attorneys with the appeal processes at the National Department of Agriculture, Forestry and Fisheries.

Several rezoning applications submitted to the City of Tshwane and Ekurhuleni Metropolitan as well as Madibeng, Mookgophong and Kungwini Local Municipalities. Applications were done in terms of the Town Planning and Townships Ordinance, 1986 and the Spatial Planning and Land Use Management Act, Act 16 of 2013.

Temporary rights obtained for specific projects or events.

Restrictive conditions in the title deed of a property can be removed by means of the Gauteng Removal of Restrictions Act (Act 3 of 1996) and and the Spatial Planning and Land Use Management Act, Act 16 of 2013.

Typical conditions will be:

• The holding / property may not be subdivided nor may any share in it or portion of it be sold, leased or disposed of in any way without the written approval of the Townships Board.
• The holding shall not be sold or held jointly by two or more persons.
• Not more than one dwelling house, together with such outbuildings as are ordinarily requested to be used in connection therewith, shall be erected on the land, or any subdivision of the land approved in terms of Clause 1 except with the approval of the Townships Board.
• No buildings erected on the holdings /property shall be located within a distance of 30,48 meters from the boundary of that holding abutting a road.
• No store or place of business shall be opened or conducted whatsoever on the holding/property or land.

The Town Planning Scheme stipulates that there are building restriction lines on a property. When owners do alterations to their property and exceed the building line, they must apply for relaxation of a building line at Council.

Town Planning Projects were put together by Carlien Potgieter which included the following professionals:
Civil Engineers, Traffic Engineers, Geotechnical Engineers, Environmental Consultants, Floodline Specialists, Agricultural Specialists, Electrical Engineers, Land Surveyors, Architects, etc.

Project meetings, budgets, costing, agenda’s, minutes etc. was managed and prepared for the clients according to time scales. Assistance in public participation processes especially with regard to the environmental process.

All Town Planning applications were made by Carlien Potgieter and she was involved in the negotiations with the client, the design of the layouts / subdivisions or site plans, the submission of the applications to the Municipalities, negotiations with internal and external departments, managing the project team as well as general project management on each project.

In some instances a deudiligence was done for the clients as well as the facilitation of the project after approval by the Municipalities in order for transfer of the properties to take place.

She has been involved in the marketing, administration and general running of Teropo Town Planners from 2005 until present.

Carlien has done her M100 for estate management and was 4 years a board member of Willow Acres Estate as Aesthetic Director.

As a separate service she draws up house rules for residential estates taking into consideration the estate, conditions of establishment and the Town Planning Scheme applicable. She also manages her own property portfolio.
